Terms of Service
These Terms of Service govern your use of the Tuesday Boutique website and any purchase you make through it. By placing an order with us, you agree to these terms.
1. Acceptance of these terms
By accessing this website or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy, Shipping Policy, and Refund and Return Policy. If you do not agree, please do not use this site.
2. Who operates this store
Tuesday Boutique is based at 3-5 Woburn St, Darch WA 6065, Australia. See our Contact page for business details.
3. Eligibility
You must be able to form a legally binding contract to place an order with us. If you are under 18, you may only use this site with the involvement of a parent or guardian.
4. Products and descriptions
We aim to describe every product accurately, including sizing, materials, and colour. Product photography is intended to show each item as faithfully as possible, but slight variations between the pictures and the item you receive can occur through screen settings, photography lighting, and normal production differences between batches. If a product listing contains an error, we will correct it and, where an order was affected, contact you before proceeding.
5. Pricing and currency
All prices on this store are shown in Australian Dollars (AUD). Tuesday Boutique is not currently registered for GST in Australia, so no GST is added to or included in any price. We reserve the right to correct a pricing error before an order is confirmed; if this happens after you have paid, we will contact you with the option to proceed at the corrected price or receive a full refund.
6. Order acceptance and cancellation
Placing an order is an offer to purchase, which we may accept or decline (for example, if a product is unexpectedly unavailable or we suspect fraudulent activity). We will notify you if we decline or need to cancel your order, and refund any payment already taken in full.
7. Payment
We accept Visa, Mastercard, Maestro, American Express, Apple Pay, and Google Pay, processed securely through Shopify Payments. Full detail lives on our Payment Policy page. Card details are processed securely by our payment provider; Tuesday Boutique never stores your full card number.
8. Shipping and delivery
We ship to Australia only. Shipping is free on every order. Orders are processed within 1 to 3 business days, then typically take a further 8 to 14 business days in transit – 9 to 17 business days in total – as products ship directly from our partner fulfilment centres rather than from Tuesday Boutique-held stock. 9. Returns and refunds
Our voluntary 30-day return policy and your non-excludable rights under the Australian Consumer Law are both set out in full in our Refund and Return Policy. Nothing in these Terms limits those rights.
10. Intellectual property
All content on this site, including text, layout, graphics, and the Tuesday Boutique name and branding, belongs to Tuesday Boutique or its licensors. You may not copy, reproduce, or reuse it without our written permission.
11. Acceptable use
You agree not to misuse this site, including attempting to gain unauthorised access to it, interfering with its operation, or using it for any unlawful purpose.
12. Third-party services
Our store relies on third-party services to operate, including our e-commerce platform, payment provider, and fulfilment partners. We are not responsible for the independent acts of these providers, but we remain responsible to you for your order and your rights under these Terms and Australian law.
13. Limitation of liability
To the extent permitted by law, Tuesday Boutique is not liable for indirect or consequential loss arising from your use of this site or a purchase made through it. Nothing in this section excludes, restricts, or modifies any guarantee, right, or remedy you hold under the Australian Consumer Law, which cannot be excluded by contract.
14. Indemnity
You agree to indemnify Tuesday Boutique against any claim arising from your breach of these Terms or your misuse of this site, to the extent permitted by law.
15. Your Australian Consumer Law rights are preserved
Nothing in these Terms, including the governing-law clause below, excludes, restricts, or modifies the consumer guarantees you hold under the Australian Consumer Law. Those guarantees apply regardless of where Tuesday Boutique is legally based.
16. Governing law and jurisdiction
These Terms are governed by the laws of the State of Western Australia, Australia, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), without prejudice to section 15 above.
17. Severability
If any part of these Terms is found unenforceable, the remaining parts continue to apply in full.
18. Changes to these terms
We may update these Terms from time to time. The version in effect at the time of your order applies to that order.
